A Declaration

We the Residents, Property Owners, Business Owners, Home Owners, and Patrons of Grantville; and the Stakeholders of the Grantville and Allied Gardens Neighborhoods, declare that our communities are not blighted and, therefore, should not be subjected to an abuse of the California Community Redevelopment Law.  Given that the City Council, Redevelopment Agency, and Development Services Division of the City of San Diego are determined to promote redevelopment in our communities, We set forth that each project must comply with these conditions and goals:

I. We reject the assertion that our communities are blighted.  The term redevelopment, therefore, is not appropriate.  The goal of the project shall be to enhance the quality of life of the current Residents, Property Owners, Business Owners, and Patrons of Grantville and Allied Gardens.  Each current Subarea of the Grantville Redevelopment Project shall, therefore, be renamed to reflect this goal and to more accurately identify its location as follows:  Subarea A as the "Grantville Community Enhancement Project;" Subarea B as the "Sand and Gravel Pit Enhancement Project;" and Subarea C as the "Allied Gardens Enhancement Project."

II. The Grantville Action Group, an independent organization, has been convened to guard the interests of Grantville Property Owners, Business Owners, Home Owners, and Patrons; and Grantville and Allied Gardens Stakeholders.   The Group will meet on a regular basis to review proposals, advise our elected officials, City agencies, and developers of the community's needs.

III. Tax Increment will not fund the projects.  All development projects will be funded solely by the project proponent and their investors, including roads, utilities, and other required public works improvements.  No loans or other funds from the Redevelopment Agency shall be used to make such improvements.  The City will continue to collect the proper amount of property tax revenue from Grantville and Allied Gardens, so that it may better meet its budgetary needs to provide community services throughout the entire San Diego City region.

IV. Each of the Community Enhancement Projects shall seek to keep existing Residents, Property Owners, and Business Owners at their current locations.  Any relocation must be voluntary.

V. Eminent Domain may not be used for private economic benefit.  Eminent Domain shall be used only for a "public use" in accordance with the strictest definition of the Fifth Amendment of the United States Constitution.  The public use must be determined and stated prior to the initiation of Eminent Domain action. 

VI. Any projects in the Grantville and Sand and Gravel Pit Community Enhancement Areas shall include public improvements that enhance traffic flow and reduce traffic congestion by maintaining Mission Gorge Road as the main thoroughfare between Interstate 8 and Zion Avenue.  New projects shall be contingent upon the prior construction of new roads that improve traffic circulation at various locations between Zion Avenue and Highway 52, ultimately connecting to Interstate 15.
